Davido and Brownhill Event agree to settle breach of contract lawsuit out of court

Nigerian musician Davido and the event organizers, Brownhill Event, have reached an agreement to settle their breach of contract case out of court.

The event organizers, led by former President of the Nigeria Football Federation (NFF) Amaju Pinnick, filed a lawsuit against Davido after he failed to appear at the annual Warri Again concert despite receiving payment and signing necessary contracts.

According to a report from Guardian Nigeria, as part of the consent judgment, Davido will pay the Brownhill Event CEO N30,000,000 (equivalent to $21,262) as a contribution to the claimant’s legal fees. Additionally, the musician has agreed to perform at the 2024 Warri Again concert scheduled for October 4 in Warri, Delta State. The $94,500 payment made to Davido for the previous concert will serve as consideration for his performance at the upcoming event.

Among other terms of the settlement, the claimant will provide a private jet to transport Davido and his team to the concert, as well as accommodation and other logistical support for his performance.

The dispute dates back to November 2023 when Brownhill Event and Amaju Pinnick sued Davido for breach of contract and defamation. They alleged that Davido had failed to show up for the 2014 and 2019 editions of the Warri Again concert after being paid for the events, leading to refunds of the payments made. The lawsuit claimed that Davido approached Mr. Pinnick expressing interest in participating in the 19th edition of the concert.

Despite signing a performance agreement with Brownhill Event Inc., Davido missed the 2023 Warri event as he had another show scheduled in Australia on the same day. Subsequently, Mr. Pinnick filed a two billion Naira breach of contract and defamation suit against Davido for making incendiary social media posts.

As part of the settlement, Davido is required to inform his followers on all social media platforms about the resolution with a specified text.

The terms of the settlement are binding on both parties and their representatives, ensuring a successful agreement between Davido and Brownhill Event.
