Obtain requisite authorisation before showing films – NFA to TV channels

The National Film Authority has issued a directive to TV channels, urging them to obtain permission for all films they broadcast on their platforms. This move comes after the Authority received complaints from film distributors around the world.

The grievances raised include the unauthorized airing of movies on terrestrial channels and media houses in Ghana without the consent of the creators or copyright owners. This action is deemed a violation of the exclusive rights of the copyright owners and carries both civil and criminal liabilities.

Under section 3(e)(iv) of the Development and Classification of Film Act 2016 (Act 935), the National Film Authority has the statutory function of ensuring compliance with copyright laws in the Ghanaian film industry. The Executive Secretary, Juliet Yaa Asantewaa Asante, has stressed the importance of obtaining proper authorization from creators or copyright owners before broadcasting any movie or film.

Channel owners and media houses are urged to assess all movies currently being aired on their platforms and verify that the necessary authorizations have been obtained. If the authorization is lacking, they must immediately cease broadcasting the film until the required permission is secured.

The National Film Authority was established by the Government of Ghana to regulate and develop the local film industry. Its role includes enforcing the legal framework for film production, distribution, and exhibition in Ghana. This move aims to streamline the ecosystem of the Ghanaian film industry and ensure compliance with copyright laws.
