Railway Development Authority CEO sued over post-retirement contract

South Dayi MP Rockson-Nelson Dafeamekpor has taken legal action against the Chief Executive Officer of the Railway Development Authority.

The MP is contesting the extension of the CEO’s contract after retirement, as he believes it exceeds the maximum five-year engagement period allowed by the Constitution.

Dafeamekpor argues that the CEO, Ernest Yao Owusu, is not eligible for the alleged one-year extension of his contract beyond retirement, which is said to span from December 18, 2023, to December 17, 2024. The MP is seeking an order to annul the one-year extension of the post-retirement contract.

Among other requests, Dafeamekpor is seeking a declaration that a public servant may only be engaged for a limited period of not more than two years at a time but not exceeding five years in all, on the condition that the exigencies of the service so require. He is also seeking other reliefs related to the interpretation of Article 199(4) of the 1992 Constitution as Amended by the Constitution of the Republic of Ghana (Amendment) Act, 1996.

This legal action highlights the ongoing debate and legal scrutiny surrounding post-retirement contracts for public servants, and it will be interesting to see the outcome of this case.
