Court declines Davido’s application for stay of proceedings in a 2 billion naira lawsuit

A recent update from the Delta State High Court reveals that Nigerian singer, Davido’s application for a stay of proceedings in a two billion naira breach of contract suit has been denied.

The suit, filed against Davido by Brownhill Investment Company Limited, is seeking N2 billion in general damages and N150 million for legal and professional fees, with an additional N30 million for the cost of filing the suit.

The defendants in the case are Davido, also known as David Adeleke, and his music label, Davido Music Worldwide Limited.

During the court proceedings, Davido’s counsel, Mr Norrison Quakers, SAN, mentioned a pending appeal and a filed motion for a stay of proceedings. However, they later withdrew the motion, stating that the Court of Appeal now has jurisdiction over the case. The claimant counsel did not oppose the withdrawal, and the court granted it accordingly.

The court ruled that until an order for a stay of proceedings is obtained from the Court of Appeal, the High Court will continue with the case.

The court also approved a motion on notice for the claimant to reply to the statement of defence and directed the filing of Pre-Trial Conference forms within 14 days, setting the next court date for March 21, 2024.

In a separate development, Davido’s preliminary objection challenging the jurisdiction of the court was dismissed, as it was argued that the case should not be held in Effurun. The court’s decision favored the continuation of proceedings in the same court.
